CHOOSZ operates this website and store, including the information, content, features, tools, products, and related services made available through it (collectively, the “Services”). Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase from us.
Please read these Terms carefully. They contain important information about order formation, payments, delivery, intellectual property, warranty disclaimers, liability, and dispute resolution.
By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, you must not use the Services.
Nothing in these Terms excludes, restricts, or overrides any consumer right or remedy that cannot lawfully be excluded under the laws applicable to you.

We may refuse, suspend, or terminate access to an account where we reasonably believe these Terms have been breached, fraudulent or unlawful activity has occurred, or such action is necessary to protect CHOOSZ, our customers, or the Services.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to describe and display our products accurately. However, colors, finishes, proportions, and other visual details may appear differently depending on your screen, device, lighting, and display settings.
Minor variations may occur between products where they result from manufacturing processes or materials and do not materially affect the product’s appearance, function, or quality. Nothing in this section limits your rights where a product is faulty, damaged, materially different from its description, or not of satisfactory or acceptable quality under applicable law.
Product descriptions, availability, and specifications may be updated without notice. We may discontinue products or limit the quantities offered to a person, household, geographic region, or jurisdiction where reasonably necessary.
Water-resistance, dimensions, materials, functions, and other model-specific information are governed by the description displayed on the applicable product page. Customers should follow all care and operating instructions supplied with the product.
SECTION 3 — ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase products from CHOOSZ. An automatic order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it.
A binding sales contract is formed when we send you confirmation that your order has been accepted or dispatched, whichever occurs first. We must receive or authorize payment before dispatching an order.
We may reject or cancel an order for legitimate reasons, including:

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.
Please review your order carefully before submitting it. If you wish to cancel or change an order, contact support@choosz.com as soon as possible. We cannot guarantee that changes or cancellation will be possible after processing or dispatch has begun. Your statutory cancellation rights and our Return & Refund Policy remain unaffected.
Products purchased through the store are intended primarily for personal or household use. You must obtain our written permission before purchasing products for commercial resale or distribution.
SECTION 4 — PRICES, PAYMENTS, AND BILLING
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout and confirmed in your order confirmation, except in the case of an obvious error that a reasonable customer should have recognized.
Taxes collected by us will be displayed at checkout where applicable. Unless expressly stated otherwise, international orders may be subject to customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.
Unless checkout expressly states that these charges are included, the recipient is responsible for applicable customs duties, import taxes, and related charges. These amounts are imposed by local authorities and are not controlled by CHOOSZ.
You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the amounts shown at checkout.
Separate terms may apply to promotions, discount codes, gift cards, or special offers. If promotion-specific terms conflict with these Terms, the promotion-specific terms will govern for that promotion.
SECTION 5 — SHIPPING, DELIVERY, AND RISK
Delivery estimates are provided in good faith but are not guaranteed. Delivery may be affected by carrier operations, customs processing, local inspections, severe weather, public holidays, or other circumstances outside our reasonable control.
We will remain responsible for the goods while they are being delivered by a carrier selected or arranged by us. Risk of loss or damage transfers to you when the goods are delivered into your physical possession or to a person identified by you to receive them, except where applicable law provides otherwise.
If you independently instruct a carrier not offered or arranged by us to collect your order, risk may transfer when the goods are delivered to that carrier, to the extent permitted by applicable law.
Please provide a complete and accurate delivery address. We are not responsible for delays or losses caused by materially incorrect information supplied by you, although we will provide reasonable assistance where possible.

SECTION 6 — RETURNS, REFUNDS, AND CONSUMER RIGHTS
Returns, exchanges, damaged items, and refunds are governed by our Return & Refund Policy.
That policy forms part of these Terms. Our voluntary return policy and any product warranty operate in addition to rights and remedies that cannot be excluded under applicable consumer law.
SECTION 7 — INTELLECTUAL PROPERTY
The Services and their contents—including our trademarks, brand names, logos, slogans, text, graphics, photography, videos, product presentation, page design, and arrangement of materials—are owned by or licensed to CHOOSZ and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Services for lawful personal and non-commercial purposes.
Without our prior written permission, you must not:

Third-party tools are made available subject to the provider’s own terms and policies. Your use of them is at your discretion, and you should review the applicable terms before use.
Nothing in this section excludes liability that cannot lawfully be excluded or limits our responsibility for selecting and integrating service providers where applicable law makes us responsible.
New features or tools added to the Services may also be subject to these Terms.

The Services may contain links to websites or content operated by third parties. A link does not necessarily mean that CHOOSZ endorses or controls the linked website.
We are not responsible for the content, availability, security, or practices of independent third-party websites. If you choose to visit or transact with a third party, you should review its terms and privacy practices.
Complaints about products or services purchased directly from a third party should be directed to that third party. This section does not apply where CHOOSZ is legally responsible for the relevant transaction.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify, which provides the ecommerce infrastructure used to operate the Services. Purchases made from this store are made directly from CHOOSZ LTD, not from Shopify.
CHOOSZ is responsible for the products it sells, order fulfilment, customer service, returns, refunds, and applicable consumer obligations. Shopify is not the seller of CHOOSZ products.
To the fullest extent permitted by law, Shopify and its affiliates are not responsible for claims arising solely from a transaction between you and CHOOSZ. Nothing in this section excludes any responsibility Shopify may independently have under applicable law.
SECTION 11 — PRIVACY
Our collection and use of personal information are governed by our Privacy Policy.
Because the Services are hosted by Shopify, Shopify may collect and process information relating to your use of the Services. Information may also be shared with payment processors, delivery providers, analytics providers, and other service providers, including providers located outside your country.

SECTION 12 — REVIEWS, FEEDBACK, AND SUBMISSIONS
If you voluntarily submit a review, photograph, suggestion, idea, or other content to us (“Feedback”), you grant CHOOSZ a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, distribute, and display that Feedback for operating, improving, and promoting the Services.
This license does not transfer ownership of your Feedback to us. It continues for as long as reasonably necessary for the purposes described above, subject to applicable privacy and consumer law.

We may correct errors and update information at any time. If a material error affects an order you have placed, we will notify you where reasonably possible and provide an appropriate option, which may include confirming the corrected order or cancelling it for a refund.
We will not rely on this section to make material retrospective changes to an accepted order where doing so would violate applicable law.

You may stop using the Services at any time.
We may suspend or terminate your access where reasonably necessary because of a material breach of these Terms, suspected fraud, unlawful conduct, security risk, payment abuse, or conduct that materially harms CHOOSZ, Shopify, another user, or the Services.
Termination does not affect rights or obligations that arose before termination, including payment obligations, accepted orders, intellectual property rights, liability provisions, and any terms that by their nature should continue.
Termination of website access does not remove any consumer rights relating to an existing purchase.
SECTION 17 — WARRANTIES AND DISCLAIMERS
We aim to provide the Services with reasonable care. However, we do not guarantee that the website will always be uninterrupted, error-free, secure, or available.
General website content is provided for informational purposes and should not replace product-specific instructions or professional advice where such advice is appropriate.

The Services and products are supplied for personal and household use unless we agree otherwise in writing. We are not responsible for business losses, including loss of profits, revenue, opportunity, goodwill, or business data, arising from consumer use of the Services or products.
We are not responsible for failure or delay caused by events outside our reasonable control, but this does not remove obligations or remedies that apply under consumer law.
SECTION 19 — INDEMNIFICATION
To the extent permitted by law, you agree to compensate CHOOSZ for reasonable losses, liabilities, and third-party claims directly caused by your unlawful use of the Services, your material breach of these Terms, or your infringement of another person’s rights.
This obligation applies only to the extent that you are legally responsible for the relevant loss or claim. It does not require you to compensate us for losses caused by our own negligence, breach, unlawful conduct, or matters for which liability cannot lawfully be transferred.
We will provide reasonable notice of a relevant claim and allow reasonable participation in its defense where appropriate.
SECTION 20 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced only to the maximum extent permitted or removed to the minimum extent necessary.
The remaining provisions will continue in effect unless the Terms cannot reasonably operate without the affected provision.

These Terms and the policies incorporated by reference form the agreement between you and CHOOSZ concerning the Services and replace previous communications concerning the same subject matter.
Nothing in this section excludes representations or rights that cannot legally be excluded.
SECTION 22 — ASSIGNMENT
You may not transfer your contractual rights or obligations without our written consent, except where applicable law permits you to do so.
We may transfer our rights or obligations to another organization as part of a merger, reorganization, sale, or transfer of our business, provided that doing so does not reduce your rights under an existing consumer contract. Where required by law, we will notify you of a material transfer.
SECTION 23 — GOVERNING LAW AND JURISDICTION
These Terms and any contract between you and CHOOSZ are governed by the laws of England and Wales.
If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the laws of the country in which you habitually reside.
The courts of England and Wales will have non-exclusive jurisdiction. If applicable consumer law allows you to bring proceedings in the courts of your place of residence, nothing in these Terms prevents you from doing so.
SECTION 24 — HEADINGS AND INTERPRETATION
Section headings are included for convenience and do not limit or otherwise affect the interpretation of these Terms.
References to “including” mean “including without limitation.” References to applicable law include amendments and replacement legislation.

The current version of these Terms will be available on this page.
We may update these Terms to reflect legal, regulatory, operational, security, or service changes. Where required by law, we will provide notice of material changes.
Changes apply from the stated effective date and will not retrospectively remove rights relating to orders already accepted unless applicable law permits or requires otherwise.
Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms as they relate to future use.
